Hot on the heels of the 2018 Farm Bill’s passage, the United States Food and Drug Administration is taking steps to reign in companies hoping to take advantage of hemp’s new legal status. Last month, FDA Commissioner Scott Gottlieb issued a clarifying statement reiterating the administration’s position that CBD cannot be used in food or medicines unless approved by the FDA. Hemp-derived food products are still legal; however, they cannot contain CBD. Likewise, hemp-derived CBD products are still legal so long as they do not make any medical claims.
