HHS Secretary

While parts of the industry argue CBD’s legal status as a dietary supplement is in doubt, all of that could change if Health and Human Services (HHS) Secretary Alex M. Azar moves to clear up the confusion. Michael McGuffin, president of the American Herbal Products Association (APA), is calling on the HHS secretary and the U.S. Food and Drug Administration to invoke their regulatory authority under the Federal Food, Drug & Cosmetic Act to issue regulations that explicitly permits the use of CBD in dietary supplements. However, some are skeptical as to whether the petition would work and believe that such a request would generate strong opposition from GW Pharmaceuticals.
